Should sacked unproductive workers lose their right to make an Unfair Dismissal claim?
Well according to Adrian Beecroft, a venture capitalist, in a report commissioned by Prime Minister David Cameron, that's exactly what he has proposed.
In the 'leaked' report, the key recommendation is to allow Employers to sack unproductive staff without explanation.
This report is just one of many commissioned by the Government as part of its ongoing review of UK Employment Laws, ties in with their ongoing efforts to cut the bureaucracy and red tape it feels is stifling business and economic growth in the UK, and follows the recent announcement by George Osbourne, in which he confirmed that the qualifying period for all Unfair Dismissal claims will be extended to 24 months from the current 12 months.
The arguement for this move is based mainly around the belief that existing rules on dismissal make it extremely difficult for Employers to determine when a staff member deserves to be dismissed, and which require them to follow a process that is time-consuming and complicated.
The report goes on to recommend a replacement regulation, called Compensated No Fault Dismissal, which would allow employers to sack unproductive staff with basic redundancy pay and notice.
