Enterprise and Regulatory Reform Act 2013: commencement dates for employment provisions

The Enterprise and Regulatory Reform Act 2013 (ERRA 2013) received Royal Assent on 25 April 2013. In a press release, BIS published provisional commencement dates for ERRA 2013. On 25 April 2013, the section which prohibits Acas from disclosing information relating to a worker, employer or trade union held by Acas in connection with the provision of Acas services came into force.

On 25 June 2013, the following reforms will be implemented:

  • The qualifying period for unfair dismissal will not apply where the main reason for dismissal is the employee's political opinions or affiliation.
  • The "simplifying of procedures and costs of deciding tribunal cases". This presumably refers to the introduction of the power to award deposit orders and costs and expenses to litigants in person.
  • Changes to whistleblowing legislation, such as the introduction of a public interest requirement and the removal of the good faith requirement.
  • The Agricultural Wages Board for England and Wales will be abolished.

Most other provisions are planned to come into effect in October 2013 or April 2014. BIS will shortly publish a detailed implementation timetable.
